We understand how important it is to protect your personal information.

 

This document sets out our privacy policy and explains how we collect, hold, use and disclose personal information about you.

We recognise that any personal information we collect about you will only be used for the purposes for which it was collected, related purposes you would reasonably expect, or as otherwise permitted by law.

Personal information

When we refer to personal information, we mean information or an opinion about you from which your identity is reasonably apparent.

The personal information we hold about you may also include credit information.

Credit information is information used to assess your eligibility for finance and may include details of finance you have applied for or have outstanding, your repayment history and any defaults. Credit information is commonly exchanged between credit providers, finance providers and credit reporting bodies.

The kinds of personal information we may collect about you include your name, date of birth, address, contact details, account details, occupation, employment and business information, identification documents, property information, financial information and any other information we may need to identify you or provide our services.

If you are applying for finance, we may also collect information about your dependants, living arrangements, length of time at your current address, employment details, income, assets, liabilities and expenses, together with supporting documentation.

Where relevant to a service we provide, we may also collect sensitive information. We will only collect sensitive information where permitted by law and, where required, with your consent.

Why we collect your personal information

We collect personal information so that we can provide our services to you and manage our relationship with you.

Depending on the services you require, this may include:

  • assessing and arranging finance;

  • assisting with residential, commercial or business lending requirements;

  • providing or facilitating property-related, financial, business or other services offered through Marl;

  • referring you to, or coordinating with, specialist service providers where appropriate;

  • verifying your identity;

  • administering and managing our relationship with you;

  • responding to enquiries and complaints;

  • meeting our legal, regulatory and record-keeping obligations; and

  • providing you with information about products, services or offers that may be relevant to you.

 

We may also collect and use personal information for direct marketing purposes as set out below.

How do we collect your personal information?

Where reasonable and practical, we will collect your personal information directly from you.

We may collect information when you communicate with us in person, by telephone, by email, through our website, through online forms or through other digital channels.

We may also collect personal information from other people and organisations, including finance brokers, lenders, referral partners, accountants, lawyers, conveyancers, employers, referees, identity verification providers and other service providers involved in assisting us to provide services to you.

Do we disclose your personal information?

We may disclose your personal information, where appropriate:

  • to prospective lenders, funders or other intermediaries in relation to your finance requirements;

  • to organisations involved in managing, processing or administering your finance;

  • to AFG and other organisations involved in providing aggregation or related services;

  • to related businesses and service providers that support the delivery of Marl services, including business processing and administrative support;

  • to organisations that provide products or services to you through or in association with Marl;

  • to property, conveyancing, legal, financial planning, accounting or other professional service providers where relevant to the services you require;

  • to third-party suppliers and service providers, including technology, communications, printing, mailing and administrative service providers;

  • to companies that provide information, technology and infrastructure systems to us;

  • to anybody who represents you, such as your finance broker, lawyer, conveyancer or accountant;

  • to your employer, referees or identity verification services where appropriate;

  • to our professional advisers, investors, agents or other parties that have a legitimate interest in our business;

  • to any person or organisation where you have provided your consent; or

  • where we are required or authorised to do so by law, including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

 

Before disclosing personal information to another person or organisation, we will take reasonable steps to ensure that the information is handled appropriately and in accordance with applicable privacy requirements.

Overseas access and disclosure

We may use cloud-based and other technology services to store and manage the personal information we hold about you.

Some of our business processing and support functions are provided by a Marl-affiliated service company located in China and the Philippines. In providing these services, authorised personnel in those countries may access personal information through our systems.

​

We may therefore disclose personal information to recipients located in China and the Philippines for the purposes of providing our services and supporting our business operations.

​

We take reasonable steps to ensure that personal information disclosed or accessed overseas is handled securely and in accordance with applicable privacy requirements.

Direct marketing

From time to time, we may use your personal information to provide you with information about finance, property, business or other services, offers you may find of interest, changes to our organisation or new products and services offered by us or through Marl.

If you do not wish to receive marketing communications from us, you may opt out at any time by telephoning us on (03) 8849 0131 or by writing to us at 113 Whitehorse Road, Deepdene VIC 3103.

 

Where the communication is by email, you may also use the unsubscribe function contained in the email.

 

We will not charge you for opting out and will take reasonable steps to action your request as soon as practicable.

Updating your personal information

It is important to us that the personal information we hold about you is accurate, complete and up to date.

 

During the course of our relationship with you, we may ask you to inform us if any of your personal information changes.

If you wish to update your personal information, please contact us. We will generally rely on you to ensure that the information you provide to us is accurate and complete.

Access and correction of your personal information

You may request access to personal information we hold about you at any time.

We will not charge you for making an access request. We may, however, charge a reasonable fee for costs incurred in retrieving and providing access to the information where permitted by law.

We will respond to your request within a reasonable period. We may need to contact other entities in order to properly investigate or respond to your request.

There may be circumstances in which we are not required to provide access to your personal information, including where providing access would be unlawful or where an exception under the Privacy Act applies.

If we refuse access, we will provide you with our reasons, except where it would be unreasonable or unlawful to do so.

If you believe any personal information we hold about you is incorrect, incomplete, inaccurate or out of date, you may request that we correct it.

​

We will take reasonable steps to investigate your request and correct the information where appropriate.

​

If we refuse to correct personal information, we will provide you with our reasons for doing so and information about how you may complain about our decision.

Using government-related identifiers

If we collect government-related identifiers, such as a tax file number, driver licence number or other identifier issued by a government agency, we will only use or disclose that information where permitted or required by law.

 

We will not adopt a government-related identifier as our own identifier of you.

Business without identifying you

In most circumstances, it will be necessary for us to identify you in order to provide our services.

However, where it is lawful and practicable to do so, you may deal with us anonymously or by using a pseudonym. For example, you may make a general enquiry about our services without providing us with identifying information.

Sensitive information

Sensitive information is a category of personal information and may include information about your racial or ethnic origin, political opinions, religious or philosophical beliefs, membership of professional or trade associations or trade unions, sexual orientation or practices, criminal record, health information and certain biometric or genetic information.

We will only collect sensitive information where it is reasonably necessary for our functions or activities, where permitted by law and, where required, with your consent.

How safe and secure is the personal information we hold?

We take reasonable steps to protect personal information we hold from misuse, interference, loss and unauthorised access, modification or disclosure.

We may store personal information in both paper and electronic form and use physical, technical and organisational safeguards appropriate to the nature of the information we hold.

When we no longer require personal information for a permitted purpose, we will take reasonable steps to destroy or de-identify it, subject to any legal or regulatory requirements requiring us to retain it.

If you are dissatisfied with how we have handled your personal information or believe that we have not complied with our obligations under the Privacy Act, you may contact our complaints officer on (03) 8849 0131.

We will acknowledge your complaint promptly and aim to investigate and respond to it within 30 days.
